ELIZABETH COSTEN WHO WAS DROWNED IN 1897
(SEE NEWSPAPER REPORT)

IN LOVING MEMORY OF
ELIZABETH COSTEN
WHO WAS DROWNED AT ALLINGTON
30th JANUARY 1897
AGED 44 YEARS

Elizabeth Costen, died 1897. The Kent Messenger reported the Inquest into her death.
"THE MISSING WOMAN FOUND IN THE MEDWAY
Mr Preston, deputy coroner, held an inquest at the Chequers Inn, Aylesford, on Saturday, on the body of Elizabeth Costen, aged 44, the wife of Charles Costen, a labourer, residing at Aylesford.
Mr S. May was foreman of the jury. Deceased left her home about half past five on Saturday evening, January 30th, with the intention of going to Maidstone by the towing path along the bank of the river. She was carrying a basket, a small bag, and a Post Office Savings Bank book.
On reaching the Malta public house she went in and rested for about ten minutes, during which time she was chatting with Mr Thomas Clegg, the landlord. On leaving, deceased made a remark as to the night being dark enough for a lantern. Nothing further was heard of her until Friday morning last, when her body was found floating in the Medway near the West Kent Cement Works at Aylesford by Robert Fitzgerald, crane driver. Deceased had promised to met her stepson in Sandling – road, Maidstone, on the night that she left home, at 7.30 in order that they might return to Aylesford together.
After waiting some time the youth proceeded home alone. Finding that his stepmother had not got back, he immediately started off for Maidstone again, but could ascertain no further particulars than that she called at the Malta.
The river was much swollen. The supposition was that the unfortunate woman had mistaken the lights at the Gibraltar, and, going straight towards them, had fallen in the river, which winds hereabouts. This surmise was confirmed when her bag was found near the spot. When discovered on Friday morning, deceased's hat and the bank book were missing, but some money was found in her pockets. A juryman stated he had known as many as twenty persons walk in the river at Allington.
The jury returned a verdict of "Found Drowned", and requested the Coroner to send a representation to the Lower Medway Navigation Company, asking them to erect a fence for the space of 200 yards where the river bends, and at the spot where the unfortunate woman is supposed to have walked into it.
Mrs Costen was well known and much respected in Aylesford, and has daughters residing in Maidstone. Only a week before the sad occurrence she had remarked that she thought her eyesight was somewhat failing.
The funeral took place on Wednesday afternoon in Aylesford Churchyard, in the presence of a large number of sympathising friends."

Codicil, not signed, witnessed or dated
He wishes farm to be sold, proceeds to be put in Bank of England, in trust, for children. Son Robert to have equal share.
His wife and John Weekes are Executors

Affidavit, dated 5th December 1811
John Weekes, Susanna Kemsley and John Stephens, Lawyer of Chatham sworn.
Weekes deposes that he knew Kemsley well and on the 23rd July 1811, was with him when he was in bed, sick.
Kemsley asked Weekes for advice on the will, of which he and George Fowle were executors.
Kemsley gave Weekes the will and said he thought his wife was an executor and that the will was not right.
George Fowle should not be an executor because he owed Kemsley a large sum. Weekes left promising to be back next day, and advised Kemsley to think about it. Next morning Weekes returned, Kemsley wanted to alter will and make his wife executor in Fowle's place. Weekes asked him if he knew what he had left his son Robert, saying he would be sorry to see any of Kemsley's children dissatisfied by the will, and advised him to consult his wife.
His wife then came to his bedside, and Kemsley said he thought son Robert should have an equal share, she agreed with him. Kemsley then asked Weekes to alter will accordingly, Susanna Kemsley then asked her husband about the farm, suggesting that it was a good time to dispose of it, Kemsley then agreed that the farm be sold.
Weekes in the presence of Mr and Mrs Kemsley, deleted the relevant lines in the will, and wrote in the margin the Codicil. He then read the will to Kemsley, who approved. Weekes suggested a new will, which Kemsley agreed to. Weekes said he would approach Mr Stephens to produce a new will.
John Stephens was sworn, he deposed that he prepared a new will as altered by Weekes. He saw Kemsley the next morning, the 25th , but Kemsley was then insensible and incapable.
Susanna Kemsley sworn, she deposed that she was present when the will was altered, and confirmed Weekes's statement. She also confirmed Stephens's statement that her husband was insensible and incapable of signing the new will, he continued in that state until her died.
Weekes, Mrs Kemsley and Stephens all swore that Kemsley was of sound mind and capable when he made the alternative will .
Proved 29th January 1812, John Weekes having renounced administration of will.
